The short version. APE Analytics is a publisher, not an ad-tech company. We collect the minimum information needed to run the business, we don't sell your personal information, and we use trusted third parties (Stripe, Discord, Cloudflare, and standard web analytics) to operate the service. Details below.
1. Who We Are
APE, LLC, a Tennessee limited liability company doing business as APE Analytics ("APE," "we," "us," or "our") operates the website located at bankonape.com and a paid Discord Community with subscription billing processed by Stripe. This Privacy Policy explains what personal information we collect, how we use it, and the rights you have under applicable law.
For the purposes of the EU/UK General Data Protection Regulation (GDPR), APE, LLC is the "data controller" of the personal information described in this Policy.
2. Information We Collect
2.1 Information You Provide Directly
- Account and subscription information — name, email address, Discord username, billing address, and payment method (payment card data is collected and stored by Stripe, not by APE)
- Support and communication — any information you provide when you email us, message us in Discord, or otherwise contact us
- Community activity — messages, reactions, and other content you post in our Discord Community
2.2 Information Collected Automatically
- Log and device data — IP address, browser type, operating system, referring URL, pages viewed, and timestamps
- Analytics data — aggregate site-usage metrics from privacy-respecting analytics providers
2.3 Information from Third Parties
- Payment processor — Stripe sends us confirmation of subscription events (successful payment, cancellation, refund) along with limited billing metadata. We do not receive full payment-card numbers.
- Discord — when you join our Community, we receive your Discord user ID and username so we can manage access.
3. How We Use Your Information
We use your information to:
- Provide, operate, and maintain the Services, including access to the paid Community
- Process subscription payments, refunds, and billing communications
- Respond to customer support inquiries and communicate about the Services
- Enforce our Terms of Service and Community rules
- Prevent fraud, abuse, and unauthorized access
- Improve the Services through aggregate analytics
- Comply with legal obligations and respond to lawful requests
Legal bases (GDPR/UK GDPR users). We process personal information on the following legal bases: (a) performance of a contract (providing the Services you subscribed to); (b) legitimate interests (fraud prevention, security, product improvement); (c) consent (where required, such as certain marketing communications); and (d) compliance with a legal obligation.
4. How We Share Your Information
We do not sell your personal information. We share it only with:
- Service providers and processors that help us operate the business (see Section 5)
- Law enforcement or government authorities when required by law, subpoena, or valid legal process
- Professional advisors such as our attorneys, accountants, and auditors, under duties of confidentiality
- Successors in interest in the event of a merger, acquisition, or sale of assets, in which case personal information will be transferred subject to this Policy
- With your consent for any other disclosure
5. Third-Party Processors
APE relies on the following categories of third-party service providers. Each processes data under its own privacy policy, which we encourage you to review.
- Stripe, Inc. — subscription billing and payment processing (Stripe Privacy Policy)
- Discord Inc. — hosting our paid Community and delivering paid content (Discord Privacy Policy)
- Cloudflare, Inc. — DNS, hosting, and web-security services for bankonape.com (Cloudflare Privacy Policy)
- Email and communications providers — for transactional and support email at bankonape.com addresses
- Analytics providers — for aggregate, privacy-respecting site metrics only (no cross-site advertising trackers)
6. Cookies and Tracking
The Site uses a limited set of cookies and similar technologies for essential functionality (such as security and fraud prevention) and for aggregate analytics. We do not use cross-site advertising trackers.
Most browsers allow you to control cookies through settings. Disabling cookies may affect Site functionality but will not prevent access to publicly available content.
7. Data Retention
We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by data type:
- Account and subscription records — for the life of the account plus seven (7) years for tax and financial recordkeeping
- Support communications — up to three (3) years after resolution
- Community messages — governed by Discord's own retention policies while active, deleted on our servers within thirty (30) days of account closure where technically feasible
- Log and analytics data — typically twelve (12) months, in aggregated form where possible
8. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, use, or disclosure. However, no system is perfectly secure. In the event of a data breach that affects your personal information, we will notify you and applicable regulators as required by law.
9. Your Rights
Subject to applicable law, you may have the right to:
- Request access to the personal information we hold about you
- Request correction of inaccurate or incomplete information
- Request deletion of your personal information
- Object to or restrict certain processing
- Withdraw consent where processing is based on consent
- Receive your personal information in a portable, machine-readable format
- Lodge a complaint with a supervisory authority
To exercise any of these rights, email privacy@bankonape.com. We will respond within the timeframes required by applicable law (typically thirty to forty-five days).
10. U.S. State Privacy Rights
California (CCPA/CPRA). California residents have the right to: (a) know what personal information is collected and how it is used and shared; (b) request deletion of personal information; (c) correct inaccurate personal information; (d) opt out of "sale" or "sharing" of personal information. APE does not sell personal information as defined by California law. To exercise your rights, contact privacy@bankonape.com.
Other U.S. states. Residents of Virginia, Colorado, Connecticut, Utah, Texas, and other states with comprehensive privacy laws have similar rights. The same email address applies for all state-privacy requests.
Verification. To protect your privacy, we will verify your identity before responding to a request. We may ask you to confirm information already on file (email, subscription date) so we can confirm the request is legitimate.
11. International Users
APE operates from the United States. If you access the Services from outside the U.S., you understand that your information will be transferred to, processed in, and stored in the U.S. and other jurisdictions where our service providers operate. Where required, we rely on Standard Contractual Clauses or equivalent transfer mechanisms.
12. Children
The Services are not directed to children under eighteen (18) and we do not knowingly collect personal information from anyone under eighteen. If you believe a child has provided personal information to us, contact us at privacy@bankonape.com and we will delete it.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be announced through the Site or the Community. The "Last Updated" date at the top of this page reflects the most recent revision.
